5 કાયદાઓમાં 12 provisionsમાં સુધારા; Self-Declaration, Risk-Based Fire Safety અને Government Services માટે Auto-Appeal જેવી મહત્વની જોગવાઈઓ

ગુજરાત વિધાનસભાના Monsoon Sessionના અંતિમ દિવસે રાજ્યમાં business અને commercial activities માટે મહત્વનો નિર્ણય લેવામાં આવ્યો છે. વિધાનસભાએ Gujarat Ease of Doing Business Bill, 2026 બહુમતીથી પસાર કર્યું છે. નવા frameworkનો મુખ્ય હેતુ businesses અને citizens પરનો unnecessary regulatory burden ઘટાડવો, procedures સરળ બનાવવા અને technology-based governanceને પ્રોત્સાહન આપવાનો છે.
હવે 24×7 Business Operationsનો રસ્તો ખુલ્યો
નવા સુધારા હેઠળ Shops & Establishmentsને લાગુ શરતો અને labour lawsને આધીન રહીને 24×7 operation કરવાની મંજૂરીનો માર્ગ ખુલ્યો છે. એટલે કે malls, restaurants, cafés, hotels, showrooms અને અન્ય commercial establishments માટે operating hours અંગેની જૂની સમયમર્યાદામાં મોટો ફેરફાર થશે.
આ નિર્ણય ખાસ કરીને retail, hospitality, food, entertainment અને urban service sectors માટે મહત્વપૂર્ણ બની શકે છે. જોકે 24 કલાક business કરવાની છૂટનો અર્થ કર્મચારીઓ પાસેથી સતત કામ લેવાય એવો નથી—workersના working hours, rest અને employment સંબંધિત કાયદાઓ યથાવત લાગુ રહેશે.
Self-Declarationથી Registration સરળ બનશે
Billમાં business registration માટે Self-Declaration અને Self-Certificationને પ્રોત્સાહન આપવામાં આવ્યું છે. સરકારનો ઉદ્દેશ શરૂઆતના તબક્કે unnecessary physical verification અને departmental interaction ઘટાડવાનો છે.
અર્થાત્, ઓછા જોખમવાળા business માટે compliance process વધુ સરળ અને technology-driven બનાવવાનો પ્રયાસ કરવામાં આવ્યો છે.
Fire Safetyમાં Risk-Based System
Gujarat Fire Prevention and Life Safety Measures Actમાં પણ સુધારા કરવામાં આવ્યા છે. હવે Fire Safety requirementsને buildingના type અને actual risk પ્રમાણે વધુ Risk-Based અને Performance-Oriented બનાવવાની જોગવાઈ છે.
સરકારનો દાવો છે કે આથી low-risk establishments માટે unnecessary compliance cost ઘટાડી શકાશે, જ્યારે public safetyના મૂળભૂત ધોરણો જળવાઈ રહેશે.
MSME માટે ‘Right to Business’
રાજ્યના MSME sector માટે પણ Bill મહત્વપૂર્ણ છે. Gujarat MSME Facilitation Act હેઠળ ‘Right to Business’ frameworkને વધુ મજબૂત બનાવવાની જોગવાઈ કરવામાં આવી છે.
Power supply, GIDC, cooperative અને irrigation સહિતના અન્ય કાયદાઓને પણ facilitation framework સાથે જોડવાનો પ્રયાસ કરવામાં આવ્યો છે. તેનો હેતુ નાના અને મધ્યમ ઉદ્યોગો માટે approvals અને complianceની પ્રક્રિયા સરળ બનાવવાનો છે.
બીજા રાજ્યના Doctors માટે Registration સરળ
Billમાં Gujarat Medical Council Actમાં પણ ફેરફાર કરવામાં આવ્યો છે. અન્ય રાજ્યમાં registered doctors માટે Gujaratમાં registration મેળવવાની પ્રક્રિયા Self-Declarationના આધારે સરળ બનાવવાની જોગવાઈ કરવામાં આવી છે.
આથી medical professionalsની mobility વધારવા અને healthcare servicesમાં manpower availability સુધારવાનો પ્રયાસ છે.
Government Serviceમાં વિલંબ થયો તો Auto-Appeal
સૌથી મહત્વની જોગવાઈઓમાંની એક Auto-Appeal અને Auto-Escalation છે.
જો કોઈ citizenની government service અથવા grievanceનો નક્કી કરેલી સમયમર્યાદામાં નિકાલ નહીં થાય, તો technology-enabled system મારફતે તે matter આપમેળે higher authority સુધી પહોંચે તેવી વ્યવસ્થા કરવામાં આવશે.
આથી સરકારી કચેરીઓમાં application લઈને વારંવાર follow-up કરવાની જરૂરિયાત ઘટાડવાનો પ્રયાસ છે.

આ Bill માત્ર business hours વધારવાનો નિર્ણય નથી. તેનો મોટો હેતુ Gujaratના regulatory systemને Control-Based Governanceમાંથી Trust-Based અને Risk-Based Governance તરફ લઈ જવાનો છે.
24×7 commercial operationsથી ખાસ કરીને urban economyમાં night-time business, hospitality અને consumer servicesને વેગ મળી શકે છે. બીજી તરફ Self-Certification અને Auto-Appeal જેવી વ્યવસ્થાઓ government-citizen interactionને વધુ digital અને accountable બનાવે તે મહત્વનું રહેશે.
પરંતુ નવા rulesનો actual benefit ત્યારે જ જોવા મળશે જ્યારે implementation દરમિયાન workers’ rights, public safety અને compliance monitoring વચ્ચે યોગ્ય balance જળવાશે.
